RES-H building obligations

Act No. 406/2000 Coll. on Energy Management and Decree No. 78/2013 on Energy Performance of Buildings stipulate that in case of any new building or building undergoing a major refurbishment owners of apartment buildings, housing associations, or building contractors have to obtain an energy performance certificate (EPC). 

The owners of apartment buildings, housing associations, or building contractors are obliged to obtain the energy performance certificate (EPC) for a building used by a public authority from 1 July 2013 with a total energy reference area of more than 500 m2 and from 1 July 2015 with a total energy reference area of more than 250 m2.

Starting from 1 January 2013, the requirements for Energy Performance Certificates (EPC) have been extended to owners of family houses and other buildings intending to sell or rent their properties. The only exception is presented by buildings with a floor area of less than 50 m², buildings used for recreational or religious purposes and industrial, agricultural buildings with very low energy consumption and others (§ 7 par. 5 Act No. 406/2000). The energy performance indicators of buildings are defined by § 3 of the Decree No. 78/2013.

The new buildings owned and operated by a public authority or body, which are established by a public authority, have to meet the energy performance requirements of a near-zero-energy building, which are included in the Energy Performance Certificate (EPC), as follows:

  • a building with the total energy reference area greater than 1500 m2 from 1 January 2016,
  • a building with the total energy reference area greater than 350 m2 from 1 January 2017,
  • a building with the total energy reference area greater 350 m2 from 1 January 2018 (§ 7 par. 1 Letter b Act No. 406/2000).

In the case of new buildings not owned by public authorities, the energy performance requirements of a near-zero-energy buildings have to meet the energy performance requirements of a near-zero-energy building, which are included in the Energy Performance Certificate (EPC), as follows:

  • a building with the total energy reference area greater than 1500 m2 as of 1 January 2018,
  • a building with the total energy reference area greater than 350 m2 from 1 January 2019,
  • a building with the total energy reference area of less than 350 m2 as of 1 January 2020 (§ 7 par. 1 Letter c Act No. 406/2000).

The building with a near-zero-energy consumption is a building with a very low energy intensity, whose energy consumption is largely covered by renewable energy sources (§ 2 par. 1 Letter W Act No. 406/2000).

Obligated entities

Obligated to commission an EPC are owners of apartment buildings, housing associations and building contractors (§ 7a par. 1 Act No. 406/2000).
